Terms of service

1. About Tikle
Tikle (tikleapp.com) is a trading name of Culture Clash Family Ltd, a company registered in England and Wales (company no. 15931404), 19 Charles Street, Newport, Wales, NP20 1JU (“Tikle”, “we”, “us”). Tikle is a marketplace where creators (“Creators”) list their existing TikTok videos and brands (“Brands”) license them. By using Tikle you agree to these terms and our privacy policy. Contact: hello@tikleapp.com.
Tikle is not part of, endorsed by or affiliated with TikTok.
2. Accounts
- You must be 18 or over and able to enter a binding contract.
- Creators sign in with their own TikTok account through TikTok’s official login. You may only connect an account you own and control.
- Brands sign in with a work email address and must be authorised to act for the business they represent.
- Keep your sign-in secure. You’re responsible for what happens on your account.
3. Creators
Listing (“Tikles”)
A Tikle is one or more of your videos matched to a brand and listed at a price you set. Listed Tikles appear in Tikle’s brand search, and you can also send a Tikle direct to a brand. On the Free plan you can list 5 Tikles a month; Tikle Pro gives unlimited Tikles (see section 6).
Your promises
For every video you list, you confirm that:
- you made it and own it, or otherwise hold all the rights needed to license it;
- everyone who appears in it has agreed to it being licensed for advertising, including a parent or guardian’s consent for anyone under 18;
- it doesn’t infringe anyone else’s rights (including trademarks, artwork or footage you don’t own), and isn’t misleading, unlawful or harmful; and
- you’ll deliver the original file (without the TikTok watermark) if a Brand buys it.
Music and TikTok sounds are never included in a licence. Deliver a version without licensed music, or tell the Brand it must add music it has licensed itself.
Commission and payouts
- When a Brand buys a licence, Tikle keeps a commission of 30% of your price on the Free plan, or 20% on Tikle Pro. You receive the rest.
- Payouts are made through Stripe to the bank account you connect. You must complete Stripe’s identity checks, and the name on your payout account must match you.
- We pay you after you deliver the original files and the Brand has had 3 days to check them (sooner if the Brand approves them). For your first 2 deals, we hold the payout for 7 days after delivery so any complaints can be checked. We may also hold a payout while we look into a report or a possible duplicate or reposted video.
- You’re responsible for your own tax on what you earn.
Staying on Tikle
If you meet a Brand through Tikle, you agree not to take a licence or deal with that Brand for the same or similar content off Tikle for 12 months.
4. Brands
- Prices on Tikle are all-in prices that include Tikle’s service fee. VAT is added where it applies.
- When you pay, Tikle holds the payment until the Creator delivers the original files. If they aren’t delivered within 7 days, you can cancel and we’ll refund you in full.
- Once files are delivered, you have 3 days to check them. You can approve them, or report a problem, which pauses the Creator’s payment while we sort it out. If you do neither, the files are treated as accepted.
- You may make offers, ask questions and propose retainers through Tikle. Offers you make are binding once the Creator accepts and you pay.
- If you meet a Creator through Tikle, you agree not to license content from or commission that Creator off Tikle for 12 months.
5. The licence
When a Brand pays and the files are delivered, the Creator grants the Brand a non-exclusive licence, for 12 months from delivery, to use the licensed videos in the UK and online worldwide in:
- paid social ads;
- organic social posts;
- the Brand’s own website and product pages;
- marketplace listings; and
- email marketing.
The Brand may make light edits (trimming, captions, resizing, adding logos or end cards). The Brand may not suggest the Creator endorses other products, sell or sublicense the videos, or use them on TV or outdoor advertising without a new licence. The Creator keeps ownership and copyright. When the licence ends, the Brand stops new use and any paid ads using the videos; organic posts already published may stay up. Each licence comes with a licence certificate showing these terms.
The licence is between the Creator and the Brand. Tikle provides the marketplace, takes payment and pays out, but doesn’t own the content.
6. Tikle Pro
- Tikle Pro costs £14.99 a month, billed monthly in advance by Stripe until you cancel.
- Pro includes unlimited Tikles, retainer deals and 20% commission instead of 30%.
- You can cancel any time in Billing. Pro stays active until the end of the month you’ve paid for, and we don’t refund part-months.
- If you’re a consumer, you have 14 days from first subscribing to cancel for a refund, less the value of any Pro features you’ve used.
7. Using Tikle fairly
You must not: list someone else’s videos; create fake accounts or offers; scrape or copy Tikle or its content; misuse “Send direct” to send spam; harass other users; or use Tikle for anything unlawful. We may limit features (for example, “Send direct” is limited to 20 emails a day) to protect the service.
8. Reports and takedowns
If you think a Tikle uses your content or breaks these terms, use the Report link on the Tikle or email hello@tikleapp.com. We may hide a Tikle, pause payouts, refund a Brand, or suspend or close an account while we investigate or if these terms are broken.
9. Our responsibility to you
- We work hard to keep Tikle running, but we can’t promise it will always be available or error-free.
- We don’t check every video, and we aren’t responsible for content Creators list or for how Brands use licensed content outside Tikle. Creators and Brands are each responsible for their own promises in these terms.
- For business users, our total liability to you in any 12 months is limited to the fees Tikle received from you (or, for Creators, the commission we kept on your deals) in that period. We aren’t liable for indirect losses or lost profits.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that can’t be limited by law, and nothing affects your legal rights as a consumer.
10. Closing your account
You can stop using Tikle at any time and ask us to close your account. Licences already bought continue for their full term, and outstanding deliveries and payouts are completed first.
11. Changes
We may update these terms. We’ll change the date at the top and, for significant changes, tell you by email or in the app before they apply. If you keep using Tikle after that, the new terms apply.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you’re a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
